Q: Can prenuptial agreements cover alimony?
It is possible, but there are very strict rules about that. It is against public policy to pre-negotiate alimony. You can put words about alimony in the agreement, but there is such a strong public policy against it, that it’s going to be closely scrutinized as to whether it is fair at the time.
Can decisions about child custody or child support be written into the prenuptial agreement?
Yes, but provisions relating to children are generally not enforceable. You cannot limit the rights of children or child support as part of agreement between the parents.
Child custody issues are never really permanent or subject to a contract between the parties because the court can always revisit the issue and change it based on what is determined to be in the best interest of the children.
